The petitioner School has come up with this Writ Petition seeking a direction to the 1st respondent Government to process their application dated 12.03.2016 for "No Objection Certificate" and pass appropriate orders granting "No Objection Certificate" to them for taking affiliation from the Central Board of Secondary Education.
According to the petitioner, one of the Societies of the Roman Catholic Congregation, viz. Immaculate Heart of Mary's Society, Cuddalore, sensed the need of the local area in Cuddalore District to have a School and proposed to start a School in the name and style of St. Anne's CBSE Girls Higher Secondary School, Cuddalore from the academic year 2016-2017 with affiliation from the Central Board of Secondary Education. Since a 'No Objection Certificate' from the State Government is required for the purpose of affiliation from CBSE, the petitioner submitted an application dated 12.03.2016 to the 1st respondent seeking 'No Objection Certificate' for the proposed School. Since no reply is forthcoming from the 1st respondent, having no other alternative, the petitioner is before this Court. Heard the learned counsel on either side and perused the material documents available on record.
Considering the facts and circumstances of the case, this Court directs the 1st respondent herein to consider the petitioner's representation dated 12.03.2016 seeking 'No Objection Certificate', on merits and in accordance with law and pass appropriate orders within a period of two months from the date of receipt of a copy of this order.
This Writ Petition is disposed of with the above direction. No costs. Consequently, connected W.M.P.No.2062 of 2017 is closed.
