This petition is filed to condone the delay of 164 days in filing the above appeal.
2.The learned counsel for the petitioner submitted that the first respondent remained exparte before the Tribunal and and hence no notice is necessary for first espondent.
3.Though notice was served on the second respondent and his name is printed in the cause list, there is no representation on behalf of him either in person or through counsel.
4.Heard the learned counsel appearing for the petitioner. 5.Being satisfied with the reasons stated in the affidavit filed in support of the above petition, the delay of 164 days is condoned and the petition is ordered. It is made clear that the petitioner/appellant is not entitled for any interest for the compensation amount enhanced, if any, in the appeal.
