W.M.P.Nos.7516 of 2019, 24374 & 25121 of 2021 and 18182 & 18432 of 2022 in W.P.Nos.6705 & 4071 of 2019 S.M.SUBRAMANIAM.J., The learned counsel appearing on behalf of the National Highways and the learned Additional Government Pleader made a submission that the objections submitted by the writ petitioners were elaborately considered by the Special District Revenue Officer (Land Acquisition) and an order was passed. The alignments of the Highways were completed in respect of NH-45A and on account of the interim order, the road projects are stalled.

2. The learned counsel for the petitioner states that some of the owners have not received notice from the competent authorities. All these disputes are to be resolved by way of adjudication. However, in the interest of the public, the road projects need not be stalled unnecessarily. The petitioners are at liberty to raise all their grounds at the time of final hearing of the writ petitions for the purpose of securing the relief.

3. Stalling of public welfare projects are not preferable. If at all certain procedural violations are raised, that should be adjudicated and appropriate Page 1/3

relief is to be granted. If the public welfare projects are stalled in its entirety, it will have larger repercussions and more specifically, it would cause prejudice to the people as well as affect the trading activities.

4. Thus, the authorities / respondents are permitted to proceed with the project, subject to the further orders of this Court. In view of the facts and circumstances, the interim order granted in all the petitions are vacated.

5. Post these matters after vacation.
