C.M.P.No.7871 of 2023 in C.M.A.SR.No.16900 of 2023 SUNDER MOHAN,J.

This Petition has been filed seeking to condone the delay of 146 days in filing the above captioned C.M.A.

2.This Court vide order dated 24.07.2023, permitted the petitioner to take substituted service for the 2nd respondent by publishing the notice in an Tamil daily circulated in Coimbatore District.

3.Today, learned counsel appearing for the appellant filed affidavit of service along with newspaper for proof of service. 4.Though name of the respondents are printed in the cause lists, none appeared on behalf of both the respondents.

5.Considering the averments made in the affidavit filed in support of this petition and being satisfied with the same, the delay is condoned. Hence, this petition is ordered as prayed for.

6.Registry is directed to number the C.M.A., if it is otherwise in order and list the same in due course.
