In a proposed suit for recovery of money, jointly and severally, from defendants 1 to 15, the intending plaintiff seeks leave to sue respondents 9 to 15 before this Court. In the draft plaint, the intending plaintiff has SENTHILKUMAR RAMAMOORTHY,J 1/2 https://www.mhc.tn.gov.in/judis

rna alleged that monies invested in respondents 1 to 8 were transferred to respondents 9 to 15. It is also stated that respondents 1 to 8 carry on business within the jurisdiction of this Court. It is also stated that the cause of action arose within the jurisdiction and that cheques issued by the defendants were returned by Kotak Mahindra Bank, R.K.Salai Branch, Chennai.

2. Upon considering the draft plaint and the affidavit in support of this application, it appears that at least a part of the cause of action arose within the jurisdiction of this Court. Therefore, this application is allowed by granting leave to the applicant to sue respondents 9 to 15 before this Court. Consequently, the Registry is directed to number the suit, if otherwise in order.
