Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Declaration, declaring the transfer counseling held 30.12.2015 onwards, in pursuance of the circular of the Second Respondent dated 22.12.2015 in Reference No. 58233/E3/1/2015 for Service PG Students who have not completed their PG Degree and who are not in service as Tutors/Junior Residents/Senior Residents/Assistant Professors/ Assistant Surgeon to choose the vacant posts of Tutors/Junior Residents/Senior Residents/Assistant Professors in Medical Colleges under the control of the Second Respondent is null and void since the same is contrary to the Medical Council of India Act and the Minimum Qualification for Teachers in Medical Institutions Regulations, 1998, and consequential direction to fix a fresh date for counseling for the Petitioners for the vacancies numbering about 313 created due to the exclusion of the Service PG Students in various medical colleges.
