ORDER

This Writ Petition has been filed seeking a direction to the second respondent to grant posting for the petitioner in a PAP scheme of the second respondent as per the representation dated 27.08.2022 and 30.06.2023 through Sangam by adhering the Rehabilitation and Resettlement Act.

2. Heard Mr.R.Surendran, learned Additional Government Pleader appearing for the first respondent and Mr.N.Nithyanandam, learned counsel appearing for the second respondent.

3. The case of the petitioner is that his family lands were acquired by the second respondent for mining projects, and though compensation was paid, employment assured to Project Affected Persons (PAP) under the Rehabilitation and Resettlement Act, 2013 has not been provided till date. While awaiting such employment, the second respondent issued Advertisement No.02/2023 calling

for online applications for Industrial Trainees with eligibility conditions, which is contrary to the petitioner's statutory entitlement. Despite repeated representations dated 27.08.2022 and 30.06.2023, no action was taken, hence the present Writ Petition.

4. Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the second respondent to consider the representation of the petitioner dated 30.06.2023 and pass appropriate orders on the same within the time that may be stipulated by this Court.

5. On the above contention, this Court heard the learned counsel appearing for the respondents.

6. In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the second respondent to consider the petitioner's representation dated 30.06.2023 on merits and pass appropriate orders on the same in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.

7. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
