ORDER

This Criminal Original petition has been filed seeking a direction to the 3rd Respondent to register a case based on complaint dated 29.04.2016.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. It is the case of the petitioner that the opposite party had collected money from the petitioner for giving MLA seat and thereafter, the opposite party neither gave the seat nor returned the money.

4. The learned Additional Public Prosecutor, on instructions, submitted that the complaint given by the petitioner is pending before the third respondent.

5. Recording the submission of the learned Additional Public Prosecutor, the third respondent police is directed to conduct enquiry expeditiously and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government of Uttarpradesh and Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under intimation to the petitioner.

With the above directions, this Criminal Original Petition is closed.
