This petition is filed by the petitioner / appellant seeking to condone the delay of 163 days in filing the above appeal.

2.Heard learned counsel appearing for both sides.

3.Having regard to the reasons stated in the affidavit filed in support of this petition, more particularly, para 9, this Court is inclined to condone the delay, subject to payment of Rs.2,000/- (Rupees Two Thousand only) towards costs to the Chief Justice Relief Fund, High Court, Chennai, within a period of two weeks from the date of receipt of this order, failing which, this order will stand automatically cancelled, without further reference to this court.

4.Upon payment of costs and production of the receipt, this petition stands ordered.
