Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition that the petitioners may offer sureties of petitioners friends and the Judicial Magistrate NO.I, Ponneri shall accept the said sureties without demanding sureties of Blood relations of the Petitioners in Crl.O.P.No.2105 of 2019 dated 1.2.2019.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.R.SASIKUMAR Advocate for the petitioner and of MR.C.RAGHAVAN Government Advocate [crl.side] on behalf of the Respondent the court made the following order:- This petition has been filed seeking to modify the condition imposed by this Court by an order dated 01.02.2019 made in Crl.O.P.No.2105 of 2019 to the effect that "the petitioners shall jointly pay a sum of Rs.25,000/-(Rupees Twenty Five Thousand only) by way of demand draft, directly to the Dean, Stanley Medical College and Hospital, Chennai, and on such deposit the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Ponneri".
2. The learned counsel for the petitioner would submit that the petitioners are from Madhyapradesh and they are working as labours in Tamil Nadu without their family members. Therefore, they are not able to execute the sureties as per the order passed by this Court.
Hence, he prays for modification.
3. Considering the facts and circumstances of the case and submissions made by the learned counsel for the petitioners, this Court is inclined to modify the condition imposed by this Court in Crl.O.P.No.2105 of 2019 dated 01.02.2019 to the effect that "the petitioners shall jointly pay a sum of Rs.25,000/-(Rupees Twenty Five Thousand only) by way of demand draft, directly to the Dean, Stanley Medical College and Hospital, Chennai, and on such deposit the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with two local sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Ponneri".
