ORDER
The petitioner, who was arrested and remanded to judicial custody on 15.12.2025, for the alleged offence punishable under Sections 5(l), 5(j)(ii) r/w. 6 of the Protection of Children from Sexual Offences Act, 64(2)(m), 65(1), 351(2)
of BNS 2023 in Crime No.41 of 2025 on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that the petitioner has committed aggravated penetrative sexual assault continuously on the victim girl aged about 15 years, resulted pregnancy and fetus was also aborted. Hence, the case has been registered.
3. Earlier bail petition of the petitioner was dismissed on 27.01.2026 in Crl.O.P.No.1535 of 2026 on the following reasons: "6.Considering the facts of the case and the statement recorded from the victim girl which reveals that the manner in which the occurrence has taken place and it is a case of aggravated penetrative sexual assault, this Court is not inclined to grant bail to the petitioner."
4. Considering that there is no change in circumstances and I am not inclined to reconsider the earlier order. Accordingly, this Criminal Original Petition is dismissed.
