Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to disburse the belated payment of interest amount of Provident Fund, Gratuity, Leave Surrender and other unsettle benefits of Earned Leave salary surrender for the year of 2009-2011 & 2017-2018, 12(3) wage settlement arrears and 10 days salary with effect from 30.04.2020 within the stipulated time as may be fixed by this Court.

ORDER

This Writ Petition has been filed in the nature of a Mandamus seeking a direction to the respondent to pay interest for the belated payment of Provident Fund, Gratuity and Earned Leave Surrender and other benefits. 2.In the affidavit filed in support of the writ petition it had been stated that the petitioner had joined service as Technical Assistant in the Tamil Nadu State Transport Corporation (Salem) Limited, Salem on 10.01.1986 and retired from service on attaining the age of superannuation on 30.04.2020. The petitioner was serving as Senior Tradesman under the control of the respondent. It had been stated that the Provident Fund, Gratuity and Earned Leave Surrender and other benefits was paid only on 30.06.2024, nearly three years and ten months after the date of retirement. For that three years and ten months delay, the petitioner seeks interest. In this connection, the petitioner had given a representation dated 05.02.2025. 3.Heard the learned Standing Counsel for the respondents.

4.A direction is issued to the respondent to examine the service register of the petitioner and examine the benefits payable to the petitioner and also examine the dates on which it had been paid to the petitioner and if there a delay, pay interest at 6% per annum from the date of retirement till the date of actual disbursement. The entire exercise must be completed within a period of three months from the date of receipt of a copy of this order.

5.With the above observations, this Writ Petition stands disposed of. No costs.
