COMMON PRAYER: Criminal Original Petitions are filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to call for records pertaining to Crime No.49 of 2024, pending on the file of the first respondent namely Inspector of Police, All Women Police Station East, Near Big Vinayaka Temple, Puliakulam, Coimbatore - 641 045 and quash the same.

In both Crl.O.Ps.

For Petitioners : Mr.Nithyesh Nataraj for Mr.Anirudh A Sriram For Respondents For R1 : Mr.R.Vinothraja Government Advocate (Crl.Side) For R2 : Mr.J.Kingsly Solomon COMMON ORDER Today, the matters are listed before this Court under the caption 'For Being Mentioned' at the instance of the learned counsel appearing for the petitioners.

The learned counsel appearing for the petitioners submitted that this Court by an order dated 27.03.2025, dismissed the petitions for the reason that the first respondent filed the charge sheet in Crime No.49 of 2024, before the Additional Mahila Court, Coimbatore, on 26.03.2025. He further submitted that in pursuant to the above order, they filed copy application before the trial Court for certified copy of the final report in Crime No.49 of 2024. But it was returned for the reason that no charge sheet has been filed in Crime No.49 of 2024. Hence he prayed for necessary direction.

The learned Government Advocate (Crl. Side) appearing for the first respondent once again reiterated that the investigation has been completed in Crime No.46 of 2024 and they filed final report before the Additional Mahila Court, Coimbatore. However, it was returned for want of some corrections. Now the first respondent is about to represent the final report in Crime No.49 of 2024.

Considering the above submissions, the trial Court is directed to take cognizance on the final report filed by the first respondent in Crime No.49 of 2024, within a period of two weeks from the date of filing of the final report. The petitioners are at liberty to challenge the same in the manner known to law, if so advised. 4.

Accordingly, both the Criminal Original Petitions are clarified.
