Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, to survey the land dispute in the register of Sub Registrar Office bearing NO.7674/2005 and settle the dispute in the survey NO.419/1 at Sholinganallur Taluk Perambakkam to the extent of 0.10 cents with the assistance of Police personnel as per the complaint given by petitioner on 7.10.2013.

By consent, the main writ petition is taken up for final disposal.

2. The petitioner claims that he has purchased the lands admeasuring to an extent of 10 cents in Survey No.412/2 situated at Perambakkam Village by way of a registered sale deed bearing Document No.1177 of 2002 and there is a dispute with regard to the said land. The petitioner would further state that he approached the office of the 1st respondent and applied patta for the said land and he was informed that the correct Survey Number is 419/1 instead of 412/2. The petitioner would further state that one Natarajan is also attempting to interfere with his possession and also threatening him with dire consequences and in this regard, he lodged a complaint dated 03.06.2011 on the file of the Sub Inspector of Police, S-10 Police Station, Madipakkam and since, he has not been favoured with any kind of response, came forward to file this writ petition.

3. Heard the submissions of Mr.K.Gowthaman, learned counsel appearing for the petitioner and Ms.P.Rajalakshmi, learned Government Advocate, who accepts notice for the respondents.

4. Though the petitioner has sought for a larger relief, in the facts and circumstances of this case and without going into the merits of the representation, this Court, permits the petitioner to submit a fresh representation to the 1st respondent for grant of patta within a period of two weeks from the date of receipt of a copy of this order and on receipt of the same, the 1st respondent is directed to consider the said representation, on merits and in accordance with law, after putting the concerned person on notice and pass orders, as expeditiously as possible and not later than twelve weeks, thereafter and inform the decision taken to the petitioner as well as to the persons concerned. 5 . The writ petition is disposed of, accordingly. No costs.
