PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, for the issuance of Writ of Mandamus, to direct the respondents to consider the representation dated 09.02.2025 and direct the respondents to permit the petitioner to resume their activities and conduct the lawful activities.

O R D E R

This Writ Petition has been filed for a direction to direct the respondents to consider the representation submitted by the petitioner dated 09.02.2025 seeking permission to resume and conduct their activities in the petitioner's cultural centre.

2. In this regard, the petitioner also already filed a suit in O.S. No. 2980 of 2019 along with application for temporary injunction in I.A. No. 2 of 2019 on the file of the XIV Assistant City Civil Court, Chennai by an order dated 22.09.2023 as against the respondents.

3. On perusal of the committal revealed that the petitioner's cultural centre was closed in the year 2020. When the respondents about to close the cultural centre of the petitioner since the members of the petitioner were charged for the offences under Section 45 and 46 of the Tamilnadu City Police Act in C.C. No. 1102 of 2023 and they were convicted by payment of fine in C.C. No. 1102 of 2023. Thereafter, the petitioner submitted representation to restore their cultural centre activities on 09.02.2025. Therefore, at the time of obtaining injunction, the petitioner's cultural centre was not functioning. Now, after completion of trial, now the petitioner submitted representation seeking permission to resume and conduct their activities in the petitioner's cultural centre.

4. In view of the above, the fifth respondent is directed to inspect the petitioner's cultural centre and conduct enquiry after giving opportunity and pass orders within a period of eight weeks from the date of receipt of copy of this order.
