Respondents Prayer: Plaint filed under order IV, Rule 1 of O.S.Rules read with Order VII, Rule 1 and Section 26(1) of CPC praying (a) to direct the 1st defendant to execute and register the Sale Deed in question in favour of the plaintiff in respect of the property in the schedule, on accepting the contracted purchase money less the amount already paid as an earnest money and to direct the 1st defendant to execute and register the sale deed within a time specified by the court, failing which the said deed be executed and registered according to the provisions of Or.21,Rule 34(5) and 6(a) of CPC, or in alternative, direct the 1st defendant to repay a sum of Rs.43 lakhs which was received by the defendant with 24% interest from the date of receipt of the amounts to the date of payment to the plaintiff. (b) permanent injunction restraining the 1st defendant and her agents / representatives from alienating the schedule mentioned

property in any manner whatsoever;

(c) and for costs of the suit.

JUDGMENT

Learned counsel for the plaintiff seeks permission of this Court to withdraw the suit and he has also made an endorsement to that effect.

2. In view of the submission made by the learned counsel for the plaintiff, the suit is dismissed as withdrawn. No costs. Consequently, the connected O.A.No.926 of 2013 is closed. 04.01.2019 Index:Yes/no Internet:Yes/no speaking order/non-speaking order.
