Application No.4464 of 2016 in C.S.No.898 of 2006 M.SUNDAR, J., Mr.C.P.Sivamohan, learned counsel for the respondents / plaintiffs and Mr.V.Lakshmi Narayanan, learned counsel for the applicant / sole defendant are before this Court.
2. These applications are in a partition suit. An order came to be passed by this Court on 21.09.2016 in this application directing the applicant / defendant to pay a sum of Rs.60,000/- (Rupees Sixty Thousand only) towards costs within a period of two weeks there from.

The learned counsel for the applicant / defendant would submit that he has taken a demand draft for Rs.60,000/- (Rupees Sixty Thousand only) and that the same has been taken in the name of the counsel for the respondents / plaintiffs owing to the fact that there are three respondents / plaintiffs and there was no clarity on whose name it should be taken.
4. Mr.C.P.Sivamohan, learned counsel for the respondents / plaintiffs has fairly stated that there is some hesitation in receiving the demand draft towards costs in the name of counsel.

5. This Court is able to appreciate the hesitation of the learned counsel for the respondents / plaintiffs. However, this Court is informed that the respondents / plaintiffs have been informed about the development. In this view of the matter, this Court is inclined to direct the learned counsel for respondents / plaintiffs to receive the demand draft, which is tendered in Court today.
6. Therefore, on orders of this Court, the learned counsel for the respondents / plaintiffs has received the demand draft towards costs. The said demand draft has been taken within the stipulated period of two weeks, and therefore the order dated 21.09.2016 has been complied with. The details of the demand draft are as follows:- D.D.No.354688 dated 26.09.2016 drawn on Corporation Bank, Chennai - Shastrinagar (1285) payable at all branches of Corporation Bank for a sum of Rs.60,000/- (Rupees Sixty Thousand only) favouring C P Sivamohan, learned counsel for the respondents / plaintiffs.
