Respondent in both Petitions Prayer: Writ Petitions filed under Article 226 of the Constitution of India for issuance of writ of mandamus directing the respondent to pay subsistence allowance for the period of suspension from 11.08.2014 to the petitioners and to conclude the enquiry in respect of allegation alleged against THEM within a stipulated time.

For Petitioners : Mr.V.Rajinikanth For Respondent : Mr.S.Muthuraj C O M M O N O R D E R The petitioners seek a writ of mandamus directing the respondent to pay them Subsistence Allowance during the period of suspension and conclude the enquiry initiated against them as expeditiously as possible.

2. The petitioners are employees of Tamil Nadu State Marketing Corporation Ltd. The respondent, alleging that the petitioners had committed serious act of misconduct, suspended them from service. Thereafter, Disciplinary Proceedings were initiated against them. It is the grievance of the petitioners that during the currency of Disciplinary Proceedings, they were not paid Subsistence Allowance.

3. The learned Standing counsel for the respondent, on instructions, submitted that the Disciplinary Proceedings would be https://hcservices.ecourts.gov.in/hcservices/

concluded within a period of three months. According to the learned Standing counsel, the petitioners would be paid Subsistence Allowance during the currency of Disciplinary Proceedings.

4. The respondent is directed to pay Subsistence Allowance to the petitioners every month till the disposal of the Disciplinary Proceedings. The arrears of Subsistence Allowance should also be paid as expeditiously as possible. There shall be a further direction to the respondent to complete the Disciplinary Proceedings within a period of three months from the date of receipt of a copy of this order.

5. The writ petitions are disposed of with the above direction. No costs.
