Comprised in Survey No.6/27B, sitated at Pooncheri Vilalge, Thirukazhukundram Taluk, Chengalpattu District, which was acquired by the 2nd respondent under 3G(5) of the National Highways Act, 1956 and Section 64 of the Right to Fair Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Act, 2013, based on the representation dated 16.12.2024 submitted by the petitioner, within a time period to be stipulated by this Hon'ble Court and direct the respondents to pay interest for the compensation amount under Section 80 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, for the compensation amount, which was already paid by the respondents.

O R D E R

This writ petition has been filed for the issue of a writ of mandamus directing the first respondent to deal with the representation made by the petitioner on 16.12.2024 wherein the petitioner has sought for a direction to the first respondent to deal with the representation in line with Section 3G(5) of the National Highways Act and Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and to pay interest on the compensation under Section 80 of the Act, 2013 and pass final orders within the time frame fixed by this court.

2. Heard Mr.V.C.Janarthanan, learned counsel for the petitioner

and Mr.A.Selvendran, learned Special Government Pleader appearing for the respondents.

3. The learned Additional Government Pleader on instructions submitted that the representation/ appeal filed by the petitioner is pending before the first respondent and no final orders have been passed.

4. Taking into considering the facts and circumstances of the case and the materials placed before this court, there shall be a direction to the first respondent to deal with the representation made by the petitioner on 16.12.2024 and to pass final orders on its own merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
