ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.01.2026, for the offences punishable under Sections 80, 81, 87 of Juvenile Justice care and Protection of Children Act 2015 and Section 110 of BNS (2023), in connection with the Crime No.30 of 2026, seeks bail.

2. The case of the prosecution is that the petitioner, along with other accused, illegally adopted a child from a co-accused by paying a monetary

consideration and without following the legal process prescribed for adoption.

3. Earlier, this Court, vide order dated 09.02.2026 in Crl.O.P. No. 3006 of 2026, dismissed the bail petition filed by the petitioner with the following observation:

"5. Considering the fact that the 3rd petitioner/Kavitha (A3) has one previous case pending against her, I am not inclined to grant bail to the 3rd petitioner. However, considering the nature of the offence and the period of incarceration undergone by petitioners 1 and 2, this Court is inclined to grant bail to petitioners 1 and 2 subject to certain conditions."

4. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated and has been in judicial custody since 21.01.2026. It is further submitted that the petitioner is ready to abide by any stringent conditions imposed by this Court and, therefore, prayed for the grant of bail.

5. The learned Government Advocate (Crl. Side), appearing for the respondent police, reiterated the prosecution's case and submitted that the coaccused (A1 and A2) were granted bail by this Court on 09.02.2026. However,

the petition concerning this petitioner (A3) was dismissed due to her criminal antecedents. The learned Government Advocate further submitted that the petitioner has filed this second bail petition without any change in circumstances.

6. Considering the submissions made and noting that there is no change in circumstances since the dismissal of the previous bail application, this Court is not inclined to revisit the earlier order.
