ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under sections 4(1)(aa), 4 (1-A) of TN Prohibition Act, in Crime No. 14 of 2022 seeks anticipatory bail.
2. The petitioner herein is the owner of the vehicle bearing Reg.No. PY-01 AT 3892, which was seized by the respondent police while intercepting a suspected person riding a vehicle carrying 80 liters of alcohol and further it is alleged that the contraband and the vehicle was abandoned by the petitioner along with other accused.
3. The Learned Counsel for the petitioner would submit that the petitioner is 95% physically handicapped. The version of the prosecution is that, the petitioner accompanied with A1 and fleded on seeing the riding party is highly unbelievable.
4. This Court finds that the vehicle involved in the alleged occurrence which was used for transporting ID arrack illegally, stands in the name of the petitioner and further the petitioner on seeing the riding party, fled from the scene of occurrence. https://hcservices.ecourts.gov.in/hcservices/
5. In view of the present ground and the reason stated by the petitioner herein are not impressive and adequate, this Court is not inclined to grant anticipatory bail to the petitioner.
