Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a direction in the nature of Writ of Certiorarified Mandamus calling for the proceedings of the 2nd respondent in N.K.No.3120/2012/P2 dated 20.11.2012 and quash the same and consequently direct the respondents to promote the petitioner as Bill Collector/Junior Assistant with all consequential and attendant benefits in term of G.O.Ms.No.150 dated 19.09.1998 and in the light of the seniority position circulated on 11.05.2000, on par with his juniors and pass such 1/4

This writ petition is filed for issuance of a Writ of Certiorarified Mandamus to quash the order passed by the 2nd respondent vide N.K.No.3120/2012/P2 dated 20.11.2012 and consequently direct the respondents to promote the petitioner as Bill Collector/Junior Assistant with all consequential and attendant benefits in terms of G.O.Ms.No.150 dated 19.09.1998.

2. Today, 21.03.2024, when the matter was taken up for hearing, the learned counsel for the petitioner submitted that the petitioner has passed away and was unable to contact the legal heirs of the deceased petitioner.

3. Learned Government Advocate appearing for the respondents submitted a copy of the death certificate issued by the Registrar (Birth & Death), Government Hospital, Udumalpet, vide Registration Number : D2/4

2021:33-16209-00285 dated 12.06.2021 stating that the petitioner passed away on 01.06.2021.

4. Learned Government Advocate further submitted that all the benefits have been settled for the petitioner.

5. Learned Government Advocate also submitted a copy of the Legal Heir Certificate issued by the Tahsildar of Madathukulam Taluk, Tiruppur District, vide Certificate No.TN-7202106121271 dated 23.06.2021 and the same is recorded.

In view of the above submission made by the learned counsel on either side, the writ petition stands dismissed as abated. No costs. 21.03.2024 cda Index : Yes/No Speaking/Non Speaking order 3/4
