in C.S.No.331 of 2021 P.VELMURUGAN, J., These applications have been filed by the applicants/defendants 1 and 2 to set aside the ex-parte order dated 17.02.2022 passed by this Court in C.S.No.331 of 2021 for non-filing of the written statements.
2. Heard both sides and perused the materials available on record. 3.The learned counsel for the applicants submitted that due to COVID-19 pandemic situation there was a delay in filing the written statements.
4. The learned counsel for the respondents has no serious objection for allowing these applications.
5.On being satisfied with the averments stated in the affidavit filed in support of the applications and also considering the submissions made by the learned counsel on either side, these applications are allowed. Page No.1/3
6.Since the applicants/defendants 1 and 2 have already filed their written statements along with these applications, the Registry is directed to receive the written statements, if it is otherwise in order and place it on record and post the suit ''for framing issues'' on 22.04.2022.
7. In the meantime, both the parties are directed to file their draft issues, if they choose.
