Criminal Original Petition filed under Section 528 of BNSS, 2023, seeking to direct the 2nd respondent police to properly investigate the case in Crime No.297 of 2010, complete the investigation and file a final report/charge sheet before the concerned Judicial Magistrate within a time frame stipulated by this Court.

ORDER

This criminal original petition has been filed seeking to direct the 2nd respondent-police to conduct proper investigation and file a final report in Crime No.297 of 2010, pending on the file of the 2nd respondent.

2. When the matter was taken up for hearing, the learned Government Advocate (Crl. Side) appearing for the respondents, on instructions, submitted that the investigation in this case has already been completed and the case has been referred as 'mistake of fact' and the final report/closure report has already been filed before the Court concerned and the RCS notice has also been served on the petitioner.

3. Recording the above submission made by the learned Government Advocate (Crl. Side), this criminal original petition stands closed with liberty to the petitioner to challenge the said final report/ closure report and work out his remedy in the manner known to law. 25.02.2026 skt NCC : Yes/No 2/4
