O R D E R

To condone the delay of 77 days in preferring an application for setting aside the ex-parte decree, the revision petitioners have moved the Joint Commissioner for Employee's Compensation. The said application was returned, on the ground that pursuant to the order passed in E.C. No.243 of 2019, revenue recovery proceedings have been initiated.

2. Learned counsel appearing for the revision petitioners submitted that what prevented them from participating was the Covid lock down and submitted that ex-parte order was passed on 24.05.2021 during the peak of Covid wave - 2.

3. The aforesaid IAs are directed to be numbered and the Joint Commissioner for Employee's Compensation, is now required to dispose of the same on merit upon taking the same on their record. The registry is also required to return the original of unnumbered I.A. of 2021 to the revision petitioners, to enable them to represent the same within a period of two weeks from the date of receipt of a copy of this order.

4. The revision is accordingly allowed. However, there is no order as to costs. Consequently, the connected civil miscellaneous petition is closed. 22.04.2022 Asr Note:
