(CR.NO.102/2014) Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Crl.A.No.480/2019 on the file of the High Court, the High Court will be pleased to suspend the sentence and enlarge the petitioner on bail pending disposal of the criminal appeal No. 480/2019 filed against the judgment dated 21.03.2019 in Special S.C.No.1/2014 on the file of Mahila Court, Salem, pending disposal of the above Crl.A.No.480/2019.

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.A.No.480/2019 on the file of the High Court and upon hearing the arguments of M/S.M.RAVI, Advocate for the petitioner and of M/S. M.PRABHAVATHI, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- (Order of the Court was made by N.KIRUBAKARAN, J.) This petition has been filed by the convict for suspension of sentence of life imprisonment along with other sentences for the offence under Sections 120 (B), 450 read with 34, 363, 366, 302 read with 34, 404 read with 34, 201 read with 302 of Indian Penal Code and 5 (g) (m) and 6 of POCSO Act in S.C.No.1 of 2014 for having raped and murdered a ten year old girl child.

2.Heard the parties and perused the records.

3.Considering the facts and circumstances of the case, this Court thinks that it is not a fit case for suspending the sentence and hence, this petition is dismissed.
