Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents to restore the seniority of the petitioner bearing Registration No.NPD2006M00002027 in the employment exchange from the original date of registration so as to enable the petitioner to get the chance of employment. ORDER

The prayer in the writ petition is to direct the respondents to restore the seniority of the petitioner bearing Registration No.NPD2006M00002027 in the Employment Exchange from the original date of registration so as to enable the petitioner to get the chance of employment.

2. The case of the petitioner is that he registered his name in the Employment Exchange on 12.02.1990. The second respondent sponsored the name of the petitioner for appointment to the post of Office Assistant on 28.04.2014. On 20.06.2014 he was selected and appointed as Office Assistant and he joined the office of the Principal Sub Court, Mayiladuthurai on 25.06.2014. While so, the petitioner submitted his resignation on 06.11.2014 and the said resignation was accepted by the concerned authority on 12.11.2014. In view of the resignation being accepted, the petitioner made a representation dated 21.04.2015 to the second respondent to restore his name in the seniority list of Employment Exchange.

3. Learned counsel appearing for the petitioner submits that https://hcservices.ecourts.gov.in/hcservices/

the second respondent could be directed to pass orders on the representation submitted by the petitioner dated 21.04.2015 within a stipulated period as he is a non employee.

4. In view of the aforesaid fact, a direction is issued to the second respondent to pass appropriate orders on the representation submitted by the petitioner dated 21.04.2015 to include the petitioner's name in the live register in the Employment Exchange restoring his seniority, within a period of six weeks from the date of receipt of a copy of this order.
