CMP.Nos.5561, 5562 & 5563 of 2018 in S.A.No.1066 of 2001 ABDUL QUDDHOSE, J.

These civil miscellaneous petitions have been filed (a) to condone the delay of 1992 days in filing a petition to set aside the abatement caused due to the death of 1st respondent, (b) to set aside the abatement caused due to the death of the 1st respondent and (c) to bring on record the legal representatives of the deceased 1st respondent in the main second appeal.

2. As directed by this Court, the Appellants have effected substituted service by way of paper publication for service of notice on R5. The name of the fifth respondent is also printed in the cause list today. All other respondents have been duly served in the civil miscellaneous petitions.

3. This Court is also satisfied with the reasons stated in the affidavit filed in support of these petitions.

4. Accordingly, these civil miscellaneous petitions are allowed as prayed for.

5. Registry is directed to carry out the necessary amendment and list the second appeal for hearing on 12.08.2021.
