...Defendants PRAYER: Plaint filed under Order IV Rule 1 of the O.S.Rules read with Order VII Rule 1 of C.P.C, praying to pass judgment and decree against the defendant:-

a) Directing the defendants to jointly and severally pay the plaintiff a sum of Rs.1,00,00,000/- (Rupees One Crore only) as damages towards mental agony and compensation for negligence together with interest at 24% per annum from the date of plaint till the date of realization.

b) Directing the defendants to jointly and severally pay the plaintiff a sum of Rs.1,00,000/- (Rupees One Lakh only) towards actual reimbursement of medical expenses sustained due to the fall of ladder with interest at 24% per annum from the date of plaint till the date of realization.

c) and cost of the suit.

J U D G M E N T

When the matter is taken up for hearing today, the learned counsel appearing for the plaintiff filed a withdrawal memo seeking permission of this Court to withdraw the suit.

2.The said memo dated 03.04.2024 is taken on file and the same is signed by the plaintiff as well as the learned counsel for the plaintiff.

3.Recording the said memo, the suit is dismissed as withdrawn.
