ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 296(b), 115(2), 118(1), 351(3) of BNS in Crime No. 31 of 2026, seek anticipatory bail.

2. The allegation against the petitioners is that the petitioners herein have went to the house of the defacto complainant and demanded extending the house allotment to the petitioners and developed a quarrel, when the defacto complainant informed that the Government has directly taken steps regarding the allotment, these petitioners enraged over the same and attacked the village panchayat president with wooden log and caused severe injuries; after admitting to the hospital, the defacto complainant lodged the complaint; hence, the case has been registered.

3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Therefore, he prays for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that severe

injuries had been caused to the village panchayat president since no house allotment was made for the petitioner and it is an assault made on the people's representative. Hence, she opposed the grant of anticipatory bail to the petitioners.

5. I have gone through the FIR and other connected materials, and it revealed that the petitioners have gone to the extent of attacking the village president alleging that non-allotment of house to them; hence, this Court is not inclined to grant anticipatory bail to the petitioners; if the petitioners are granted bail, there is a likelihood that they will indulge in similar offences. Accordingly, this Criminal Original Petition is dismissed. 23-02-2026 MPA To
