JUDGMENT

(Delivered by M.M.SUNDRESH, J.) This appeal has been preferred against the order of the learned Single Judge who, despite taking note of the difficulties faced by the appellant, did not grant the relief, while giving liberty to lodge a criminal complaint against the third respondent for spoiling the prospect in pursuing his course.

2. The appellant wants to join some other course and for that, he sought for discontinued certificate or transfer certificate from the third respondent. Since it was not furnished to him, he approached the Court.

3. We have heard the learned counsel appearing for the appellant.

4. Despite service of notice and the name of the third respondent having been printed in the cause list, there is no representation on behalf of the third respondent as was the case before the learned Single Judge.

5. What the appellant seeks is only a document evidencing discontinuation. He is also entitled for the transfer certificate unless law prohibits so. We are not inclined to hold that the appellant is not entitled for the same since for the reasons known, the third respondent has not appeared before this Court.

6. In such view of the matter, we are inclined to direct the third respondent to furnish transfer certificate stated to be available with the said Institute within a period of four weeks from the date of receipt of a copy of this judgment.

7. With the above direction, the writ appeal stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
