The Second Appeal filed under Section 100 of the Code of Civil Procedure, against the Judgment and Decree made in A.S.No.61/2010, dated 29.04.2011 on the file of the Additional District Judge (Fast Track Court No.5), Coimbatore confirming the judgment and decree dated 03.12.2009 made in O.S.No.154 of 2002 on the file of the Subordinate Judges' Court, Tiruppur.

JUDGMENT

When the case came up for hearing, the learned Counsel appearing for the Appellant submitted that the entire amount had been settled to the Respondent. A compromise memo is also filed on 30.10.2023. The learned Counsel for the Respondent is also present in Court.

2. The memo of compromise dated 30.10.2023 signed by the respective parties and their respective counsel is taken on record. In the light of the compromise memo, this Second Appeal is dismissed as settled out of Court. The compromise memo shall form part of the order. 3.The Respondent is directed to withdraw the amount available before the learned Additional District Judge (Fast Track Court No.5), Coimbatore.
