This Criminal Miscellaneous Petition has been filed seeking to implead the petitioner as 5th respondent in the above Crl.O.P.
2. Mr.S.A.Shanmugam, learned counsel for petitioner/proposed respondent submitted that the 4th respondent is one of member of SRM Medical college and hospital and during the year of 2017, he received a sum of Rs.35 lakhs for getting MBBS Admission at SRM Medical College and Hospital, but he has not given any receipt for the said amount. After receipt of amount, the 4th respondent neither get admission to petitioner's daughter nor he has repaid the amount. Thereafter, he came to know that he has received money from several persons, in which the petitioner is also one of affected person and when he approached the Commissioner for refund of the said amount, he informed this petitioner to implead himself also as one of the party respondent in the above petition.
If the charge sheet is quashed against 4th respondent herein, no doubt, the petitioner may not be able to prove his innocent and he would face heavy financial loss. Hence, he filed this petition to implead himself as one of respondent in the above petition and prayed to dismiss this petition. 3.Mr.S.Vinoth Kumar, learned Government Advocate (Crl. Side), learned counsel for 1st respondent and Mr.
representing for Mr.L.Infant Dinesh, learned counsel for 4th respondent appeared and submitted that they have no objection in allowing this petition.
4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit, the above petition is allowed. The petitioner is impleaded as 5th respondent in the above Crl.O.P..
5. The Registry is directed to carry out the necessary amendment in the cause title.
