Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to recruit the Village Assistant based on the paper publication issued in Daily Thanthi dated 28.03.2015 by following G.O.Ms.No.521 Revenue Department dated 17.06.1998.

Heard both sides. By consent the writ petition is taken up for final disposal.

2.The petitioner applied for the post of Village Assistant in Udayarpalayam Taluk, Ariyalur District. Pursuant to the application, the petitioner was asked to appear for interview on 25.04.2015 at 02.00 p.m. The petitioner also attended the interview. Her apprehension is that she could be dis-qualified on the ground she is above the age of 32 years.

3.The learned counsel appearing for the petitioner has brought to the notice of this Court the news item which appeared in Daily https://hcservices.ecourts.gov.in/hcservices/

Thanthi dated 28.03.2015 calling for application to the post of Village Assistant. In the said notification, it is stated that the upper age limit for Backward Class and Most Backward Class is 32 years. The learned counsel also brought to the notice of this Court, G.O.Ms.No.521 Revenue Department dated 17.06.1998 relating to the Village Assistant service. As per Rule 5, 35 years is the upper age limit for Backward Class, Most Backward Class and Scheduled Caste. Hence, according to me, the news item in the Daily Thanthi is erroneous.

4.The petitioner has filed this writ petition seeking for direction to recruit the petitioner as Village Assistant. No such direction as sought for could be issued, but, a direction is issued to the respondent to consider the claim of the petitioner in the light of the G.O.Ms.No.521 Revenue Department dated 17.06.1998. It is for the respondent to decide about the selection or non-selection of the petitioner.
