M/S. Warrior Fms (India) Pvt v. M/S. New Chennai Township

A. Nos. 6645 of 2015 in C.S. No. D38397 of 2015 and A. Nos. 6646 of 2015 in C.S. No. D38383 of 2015 K.RAVICHANDRABAABU.,J These applications are filed for grant of leave to file the suit against the respondents which are situated outside the jurisdiction of this Court.

2. The applicant as the plaintiff seeks to file the above suit for recovery of money based on a business transaction entered into between the parties. The case of the plaintiff is that they are doing business in providing security services at Chennai, within the jurisdiction of this Court, and the respective defendants have placed work orders at the office of the plaintiff, to provide security services to them. It is further contended that the invoices were raised at Chennai by the plaintiff for the services provided to the defendants in the respective suits. Therefore, it is contented that cause of action for filing the suits has arisen within the jurisdiction of this Court.

3. Considering the above stated facts and circumstances, I am of the view that the cause of action for filing the present suits has arisen before this Court as against the respondents. Accordingly, both these application are allowed.
