This petition has been filed to withdraw the petition in H.M.O.P.No.1005 of 2025 pending before the Subordinate Judge, Alandur, Chengalpattu District to the Subordinate Judge, Tindivanam, Villupuram District. 2.Heard learned counsel for the petitioner and perused the materials available on record.
3.Despite name printed in the cause list, there is no representation on the side of the respondent.
4.Learned counsel appearing for the petitioner submits that the petitioner is residing with her aged mother and brother. The petitioner's father died and her mother is a sick person and her brother is also suffering from kidney disease and he is undergoing dialysis twice in a week. He further submits that without any assistance and guidance, the petitioner is unable to travel to the Subordinate Judge, Alandur, Chengalpattu District to attend Court proceedings. Further, the physical health condition will not support the petitioner to travel. The travelling distance between petitioner's residence and the Subordinate Judge, Alandur, Chengalpattu District is 160 kms. Therefore, he prays to transfer the case from Subordinate Judge, Alandur, Chengalpattu District to the Subordinate Judge, Tindivanam, Villupuram District.
5.I have gone through the affidavit filed in support this petition and I find no merit in the submissions made by the learned counsel for the petitioner/wife. 6.On perusal of records, it is seen that the respondent filed a petition in H.M.O.P.No.1005 of 2025 seeking restitution of conjugal rights. The respondent is working in a private concern at Pallavaram. The petitioner-wife is demanding more money from the resopndent-husband. Instead of reunion with the respondent, the petitioner filed a DVC complaint against the respondent. 7.The reason assigned by the petitioner is not justifiable. Considering the facts and circumstances of the case, this Court is not inclined to transfer the case from the Subordinate Judge, Alandur, Chengalpattu District to the Subordinate Judge, Tindivanam, Villupuram District. However, this Court directs the Subordinate Judge, Alandur, Chengalpattu District to conduct mediation between the petitioner and the respondent.
8.Accordingly, this transfer civil miscellaneous petition is dismissed. No costs. Connected, connected miscellaneous petition is closed. 04-06-2026 Index: Yes/No Speaking/Non-speaking order pam
