ORDER
The petitioner, who was arrested and remanded to judicial custody on 07.01.2026, for the alleged offence punishable under Sections 137(2) of BNS Act 2023 and 3(d) r/w.4(2), 5(m) r/w. 6(1), 9(m) r/w. 10 of the Protection of
Children from Sexual Offences Act, in Crime No.3 of 2026 on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that the petitioner herein is ranked as A2 in this case and while the victim girl aged about 7 years was playing out side her home, the petitioner has taken the victim girl to his house and committed penetrative sexual assault. Subsequently it resulted in caused injury and the victim girl intimated the same to her parents and which resulted registration of the case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case. The petitioner has been in judicial custody since 07.01.2026 and is ready to abide by any stringent conditions imposed by this Court. Hence, he prays for the grant of bail to the petitioner.
4. The Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that totally 2 accused in this case, the petitioner is ranked as A2 and he has also committed aggravated penetrative sexual assault and he has been arrested and the investigation is pending and the statement is recorded from the victim girl is directly implicated the petitioner. Hence, he is opposed for grant of bail to the petitioner.
5. I have gone through the statement recorded from the victim girl and she has narrated the way in which she was subjected to aggravated penetrative sexual assault by the petitioner herein and considering the same, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
