4. The Thasildar, Tirupur North,
5. The Village Administrative Officer, Thottipallayam Village, Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 3rd respondent to pass a speaking order determining the compensation with respect of his property at T.S.No.111 & 112 and having Door No.24, 6/179, Ravii Complex, Universal Theatre Road (Valipalayam Main Road) Tirupur 641 602 in accordance with the direction passed by this High Court in W.P.No.5418 of 2018 dated 21.03.2018.
For Petitioner : Mr.R.Selvakumar For Respondents: Mr.J.Purushothaman Additional Government Pleader
O R D E R
This writ petition has been filed for issuance of a writ of mandamus directing the 3rd respondent to pass a speaking order while determining the compensation in accordance with the earlier orders passed by this Court in W.P.No.5418 of 2018. 2.The grievance expressed by the petitioner is that even though the respondents have called for an enquiry for fixation of compensation, the petitioner is being forced to accept the compensation that was fixed on the basis of the guideline value and therefore, the petitioner apprehends that the 3rd respondent will not pass a speaking order and an order will be passed in a hasty manner.
3.This Court cannot entertain any writ petition merely based on apprehensions. This Court has given a very clear direction to the respondent in the earlier order that was passed in W.P.No.5418 of 2018. This Court hopes that the respondents act in accordance with the directions given by this Court. One writ petition cannot be filed in order to clarify an earlier order passed by this Court. If ultimately the order passed by the respondent is not in line with the earlier directions given by this Court, the remedy of the petitioner is to necessarily wait till the final orders are passed by the 3rd respondent and thereafter act in accordance with law.
4.This Court is not inclined to entertain this writ petition at this stage and accordingly the same is dismissed. Consequently, connected miscellaneous petition is closed. No Costs.
