Prayer: This writ petition has been filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 4 to consider the representation of the petitioner dated 09.01.2020 in accordance with law and direct the second respondent to survey the land with police Aid and issue patta to the petitioner's name, bearing Survey No.207/3, 200/1, 188/3, 208/19, 178/4, 178/5A, 178/6, 195/2C, 178/6, 180/2, 180/3, 180/4, 195/2C, 178/6, 180/2, 180/3, 180/4, 195/2C, 180/1C, 182/3 and 208/9 situated at Keezhputhur Village,

Vandavasi Taluk, Thiruvannamalai District to secure the ends of justice.

ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the respondents 1 to 4 to consider the representation the representation made by the petitioner, who is seeking for survey of the land and for issuance of patta in favour of the petitioner.

The learned Special Government Pleader on instructions submitted that the representation made by the petitioner has been taken on file and the date of survey has been fixed on 05.04.2020. The learned counsel submitted that necessary notice will also be served on the petitioner in this regard. The learned counsel further submitted that the petitioner can be present during the survey along with all the relevant documents.

3. In view of the above development, there shall be a direction to the 2nd respondent to proceed further with the enquiry and conduct the survey based on the document furnished by the petitioner. The entire process shall be completed and final order shall be passed, within a period of six weeks from the date of receipt of copy of this order. If during the survey any objection is made by any 3rd party, without any right or title over the property, the 2nd respondent is at liberty to seek for police protection.

This writ petition is disposed of with the above directions. No costs. Consequently, the connected miscellaneous petition is closed.
