W.P.4214 of 2002:- Writ Petition filed under Article 226 of the Constitution of India for a Writ of Certorarified Mandamus to call for the order passed by the first respondent in I.D.No.572 of 1995, dated 18/12/2000 and quash the same as illegal and direct the respondents 2 and 3 to reinstate the petitioner with backwages and continuity of service.

J U D G M E N T

[Judgment of the Court was delivered by K.K.SASIDHARAN, J.] The learned counsel for the appellant reported no instructions. The learned counsel for the second and third respondents produced a Memo of Settlement indicating that the parties have settled the matter.

2.Since the appellant is not present, we are not in a position to record the settlement. The appellant must have lost the interest in prosecuting the appeal in view of the settlement arrived at between the parties.

The intra court appeal is dismissed for non-prosecution. No costs.
