ORDER

This writ petition has been filed seeking for a direction to the first respondent to register the partition deed dated 12.11.2024 presented by the petitioners for registration in respect of the property morefully disclosed in the prayer to this writ petition.

2. The petitioners have filed supporting documents along with this writ petition to substantiate their case that they have a legal right to register the partition deed dated 12.11.2024 presented by them for registration. According to the petitioners, till date, the first respondent has not registered the partition deed dated 12.11.2024.

3. Mr.P.Harish, learned Government Advocate, accepts notice on behalf of the respondents.

4. No prejudice will be caused to the first respondent if a direction is issued to the first respondent to pass final orders on merits and in accordance

with law and take a final decision as to whether the partition deed dated 12.11.2024 presented by the petitioners can be registered or not, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of by directing the first respondent to take a final decision with regard to the request made by the petitioners for registration of the partition deed dated 12.11.2024 submitted by them for registration, after giving due consideration to the supporting documents produced by them. If the first respondent decides to refuse to register the partition deed dated 12.11.

2024 presented by the petitioners for registration, the first respondent shall pass a speaking order with regard to the contentions of the petitioners and the supporting documents produced by them for the purpose of registering the partition deed dated 12.11.2024 presented by them for registration. The first respondent is directed to complete the aforesaid exercise within a period of 12 weeks from the date of receipt of a copy of this order. This Court is not expressing any opinion on the merits of the petitioners' claim. No Costs. W.M.P.No.9175 of 2026 is ordered subject to payment of separate court fee.
