ORDER
This Writ Petition has been filed for issuance of Writ of Mandamus directing the respondents 3 and 4 to disconnect the Electricity Service Connection vide Electricity connection No.011-030-2602/V which stands in the name of 5 th respondent in the petitioner's property.
2. Heard Mrs. Daniel Mary, learned Standing Counsel for respondents 1 to 4. The 5 th respondent has refused to receive notice. Hence, there is deemed service of notice on the 5 th respondent.
3. The case of the petitioner is that he is the owner of the subject property by means of a settlement deed dated 12.07.2006 and rectification deed dated 01.07.2016. The further case of the petitioner is that patta was also issued by the Tahsildar in Patta No. 3149 and 3132 in the name of the petitioner. However, the 5 th respondent managed to obtain an electricity service connection for the subject property. Under these circumstances, the petitioner submitted a representation dated 21.01.2023 to respondents 1 to 4, requesting disconnection of the service connection given in the name of the 5 th respondent. On receipt of the said representation, the 2 nd respondent, through communication dated 07.02.2023, informed the petitioner that the representation made by the petitioner has been forwarded to the 4 th respondent and that action will be taken and intimated to him. Since there was no further progress, the present writ petition came to be filed before this Court.
4. Taking into consideration the facts and circumstances of the case and without going into the merits of the case, there shall be a direction to the 4 th respondent to conduct an enquiry by affording an opportunity to the petitioner and the 5 th respondent. The decision shall be taken by the 4 th respondent within a
period of eight weeks from the date of receipt of a copy of this order.
5. Accordingly, the Writ Petition stands disposed of with the above directions. No costs. Consequently, the connected Miscellaneous Petitions, if any, are closed.
