ORDER

The present writ petition is filed praying for a writ of Mandamus to direct the 1st respondent to remove the TASMAC shop having License No.4331, situated in Plot No.5, Shivam Avenue, Karanai Puducherry Road, Urapakkam, Chennai-603 210.

2. This writ petition is filed on the premise that the subject Liquor shop is located within 100 meters of an Anganwadi School and in close proximity to a Public Park. Apart from the above, it is also located 70 meters opposite to a Sivan Temple, which is in clear violation of Rule 8(1) of the Tamil Nadu Liquor Retail Vending (in shops and Bars) Rules, 2003. That apart, it has been submitted that the operation of TASMAC shop has resulted in the following: a) Obstruction to free and safe access to the adjoining public park; b) Nuisance, fear and insecurity to school children, women and senior citizens;

c) Congregation of intoxicated persons causing disturbance to public peace and order;

d) Serious adverse impact on public health, morality, safety and quality of life of the residents.

3. In this regard, petitioner has filed a detailed representation on 28.01.2026, however, no orders have been passed so far.

Mr.Yogesh Kannadasan, learned Special Government Pleader for 1st respondent would submit that the representation submitted by petitioner dated 28.01.2026 would be considered and appropriate orders would be passed after affording a reasonable opportunity of hearing to the petitioner and in accordance with law, within a time period to be stipulated by this Court. Agreed to by the learned counsel for petitioner.

In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to Respondents to consider petitioner's representation dated 28.01.2026, on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to petitioner and any other interested persons, within a period of six (6) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.

6. With the above directions, the writ petition stands disposed of. No costs.
