PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to directing the respondents to consider the representation dated 02.04.2018 to include the petitioner's name in the appropriate place in the select list for the year 2003-2004 along with his batch mates recruited in the year 2003-2004 with due seniority as done for similarly placed persons in W.P.No.9768 of 2012 dated 27.04.2012 and award all consequential service benefits. The grievance of the writ petitioner is that his representations dated 03.03.2017 and 02.04.2018 requesting the respondents to consider his case as per the directions issued in W.P.No.9768 of 2012, with regard to similarly placed persons were not considered. Therefore, he has filed the present writ petition.

2. Undoubtedly, the learned counsel for the writ petitioner states that even during the interregnum period, large number of cases of similarly placed persons were considered by the respondents. This apart, the respondents have not taken any action to grant seniority pursuant to the order of acquittal. This being the factum of the case, without going into the merits of the matter, the second respondent is directed to consider the representation submitted by the writ petitioner on 02.04.2018 and pass orders on merits and in accordance with law, within a period of 12 weeks from the date of receipt of copy of this order.
