ORDER

Today, when the matter is taken up, the contemnor has filed an affidavit tendering unconditional apology for not

vacating the premises as per the order dated 23.10.2013 made in CRP (NPD) 3044 of 2013 of this Court. In the affidavit, it is also stated that as per the order dated 23.10.2013, the contemnor / respondent has vacated the premises and handed over the same to the petitioner/landlord yesterday i.e. on 05.8.2015.

2. The petitioner / landlord has also returned the advance amount of Rs.15,000/- (Rupees Fifteen Thousand only) to the contemnor /respondent and the same has been accepted and received by him.

3. The affidavit filed by the respondent tendering unconditional apology is accepted. But at the same time, since the petitioner has evaded the order of this Court and failed to appear before the Court even after the issuance of statutory notice, I am inclined to impose fine on the petitioner. Accordingly, the petitioner is directed to pay a sum of Rs.1,000/- (Rupees one thousand only) as fine to the Tamil Nadu Mediation and Conciliation Centre immediately for his wilful disobedience of the order dated 03.10.2013 made in CRP.No.3044 of 2013.

4. The respondent / contemnor has also produced the receipt No.1505 dated 06.8.2015 towards payment of said fine.

5. Recording the affidavit tendering unconditional apology by the contemnor/respondent and also the receipt produced by him towards fine, this Contempt Petition is closed.
