4 REVENUE DIVISIONAL OFFICER, ARNI KOTTAM, ARNI-632 301, 5 THE TAHSILDAR, TAHSILDAR OFFICE, POLUR TOWN & TALUK, Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to issue an order of AD-INTERIM INJUNCTION restraining the Respondents from interfering with the peaceful possession and enjoyment of the Petitioner agricultural activity in Survey No.132/1, measuring an extent of about 0.20.0 hectares, situated at Venmani Village, Karapoondi Post, Polur Taluk, Tiruvannamalai District-606 803, (in WMP.NO.8215/2022) pending disposal of the WP.NO.8216 OF 2022. and; (ii) To STAY the operation of the proceedings Na.Ka.Aa.4/ 48280/2021 of the 2nd Respondent dated 29.12.2021,(in WMP.NO. 8217/2022) pending disposal of the WP.NO.8216 OF 2022.
Order : These miscellaneous petitions coming on this day for hearing upon perusing the petitions and the affidavits filed in support thereof and upon hearing the arguments of M/S.DR.R.GOURI, Advocate for the petitioner in both the petitions and of MR.YOGESH KANNADASAN, SPECIAL GOVERNMENT PLEADER on behalf of the Respondents in both the petitions, the court made the following order:- These petitions have been filed seeking an order of interim stay to stall the proceedings of the 2nd respondent and an order of interim injunction to restrain the respondents from interfering with the possession of the petitioner's property. The petitioner being an occupier of the 'Battai Poromboke' land, had made an application for issuance of patta and the said application was rejected vide the present impugned order on the ground that the subject land is the high value land with a large extent of 0.16.92 hectares and the same would be helpful for the Government to utilize for future purpose and on further, ground that the petitioner is a Government Servant and not a landless poor.
