The above petitions are filed to condone the delay of 38 days in filing the petition for setting aside the abatement caused due to the death of the sole appellant and to bring on record the petitioners 2 to 4 and the respondents 2 and 3 as the legal representatives of the deceased sole appellant and to rank them as appellants 2 to 4 and respondents 2 and 3 respectively in the above Second Appeal.

2. The objection to the said petition was that the petitioners are the second wife and children through the second wife whereas first respondent is his first wife. The first respondent in her plaint has accepted the status of the second petitioner as the second wife of deceased sole appellant.

3. In these circumstances, since there is sufficient cause given to implead the legal representatives, the petitions are ordered.

4. The Registry is directed to carry out the necessary amendment.

5. Post the matter on 17.06.2021.
