(Order of the Court was made by C.V.Karthikeyan J.) This petition has been filed seeking to condone the delay of 336 days in filing the appeal against the order dated 22.09.2021 in F.C.O.P.No.324 of 2018 on the file of the Family Court, Namakkal.

SMV 2.Notice had been directed to the respondent. Notice had been served. The learned counsel for the respondent entered appearance. 3.In the affidavit filed in support of the petition, it had been stated that the counsel had shifted his office and the papers which had been given to the counsel went missing and thereafter, the papers were recovered. The appeal was thereafter filed with a delay of 336 days.

4.Taking all the factors into consideration, the delay is condoned. This petition is allowed. The Registry is directed to number of appeal, if it is otherwise in order.
