O R D E R

(Order of the Court was made by The Hon'ble Chief Justice) The petitioner is present in Court at the behest of the third respondent in the writ petition / affected party to state that he had never instructed the filing of any contempt petition nor for that matter any writ petition, though he admits that the representation which was a prelude to the writ petition was signed by him. The signatures in the contempt petition are not those of the petitioner.

2.Learned counsel for the petitioner states that the documents came to him through a local counsel. 3.We may also note that as per the learned counsel for the third respondent in the writ petition the suit filed in respect of the same cause of action has also been dismissed. 4.In view of the aforesaid, in so far as the contempt petition is concerned, the same is dismissed. 5.We cannot rest the matter at the dismissal of the contempt petition as we would like to know as to how a

petition came to be filed in this Court in which the petitioner denies his signatures. Let the counsel for the petitioner ensure the presence of the counsel who instructed him and that counsel is directed to file an affidavit before this Court as to how and from whom he obtained the signatures in the contempt petition. 6.List on 26.11.2015.
