O R D E R

The petitioner, who was arrested and remanded to judicial custody on 11.12.2025 for the alleged offences punishable under Sections 5(1) r/w 6,7 r/w 8, 9(c)(n), r/w 10 of Protection of Child from Sexual Offences Act, 2012, in Crime No.1113 of 2025 on the file of Respondent Police, registered on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the A1 in this case intercepted the victim girl when she was walking on the road and kidnapped her and committed aggravated sexual assault on her. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner herein is falsely implicated in this case. Already this Court had granted bail to the co-accused on 03.02.2026. The petitioner is in incarceration from 11.12.2025 and he is ready to co-opearate for the investigation. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner is a lorry driver and forcebly the victim girl was taken inside the lorry and committed aggravated penetrative sexual assault and petitioner has also been identified by the victim girl. He further submitted that the investigation is pending and A2 was granted bail by this court. Hence, he opposed for grant of anticipatory bail to the petitioner. 2/4

5. I also gone through the statement recorded which had revealed that the petitioner has committed aggravated penetrative sexual assault on the victim girl and who is aged only about 15 years and investigation is pending, this Court is not inclined to grant bail to the petitioner.
